00 · Overview
These Towing & Roadside Assistance Terms of Service (“Terms”) govern customer-requested towing, roadside assistance, recovery, transportation, and related services provided by Prestige C.K. Towing Inc. (“Prestige,” “Company,” “we,” “us,” or “our”).

By requesting, authorizing, accepting, or permitting Prestige to dispatch or perform services, whether by telephone, text message, website, electronic form, or in person, you agree to these Terms.
Nothing in these Terms is intended to eliminate or restrict any right, remedy, disclosure, obligation, or protection that cannot lawfully be waived under applicable federal, Illinois, Cook County, or municipal law.
01 · Service Area
Prestige provides towing and roadside-assistance services within Cook County, Illinois, subject to truck availability, vehicle type, equipment requirements, road conditions, safety considerations, and other operational factors.
Prestige may decline any request outside its service area or any request that cannot safely or legally be performed.
Acceptance of a telephone call, text message, website submission, or quote does not by itself guarantee that Prestige will accept or complete a particular service request.
02 · Services
Prestige may provide services including towing, flatbed towing, accident towing, breakdown towing, vehicle transportation, winching and recovery, jump starts, tire changes, lockout assistance, fuel delivery, roadside assistance, vehicle relocation, and other related services expressly accepted by Prestige.
The availability of a particular service depends upon the vehicle, its condition, its location, required equipment, operator availability, and safety conditions.
04 · Information You Provide
Pricing, equipment selection, dispatch decisions, and service feasibility depend upon accurate information.
You agree to provide accurate information, to the best of your knowledge, concerning the vehicle's year, make, model, type, location, destination, operating condition, keys, steering condition, braking condition, drivetrain, wheel and tire condition, collision damage, modifications, ground clearance, accessibility, and any unusual circumstances.
You must notify Prestige if the vehicle is electric, hybrid, AWD, 4WD, lowered, lifted, oversized, commercially equipped, heavily damaged, missing wheels, located off-road, stuck in snow or mud, positioned in a ditch, located within a parking structure, blocked by another vehicle, or otherwise likely to require specialized equipment or recovery.
If the actual conditions materially differ from the information supplied, additional services, equipment, labor, or charges may be necessary.
Prestige will disclose and obtain authorization for material additional charges when required by applicable law before performing the additional work.
05 · Pricing and Quotes
Quotes are based upon the information available when the quote is provided.
Depending upon the service, charges may include towing, hook-up, mileage, roadside service, dispatch, winching, recovery, additional labor, waiting time, additional equipment, dollies, skates, specialty equipment, tolls, access charges, storage, cleanup, or other specifically disclosed services.
Where Illinois law requires a written disclosure of towing, storage, or other charges, the legally required disclosure controls.
A general website statement does not replace a specific price disclosure required by law.
Prestige will not rely upon these Terms to impose an undisclosed charge that applicable law requires to be disclosed before service.
06 · Illinois Pre-Tow Disclosures
For towing subject to the Illinois Commercial Safety Towing Law or another applicable Illinois towing requirement, Prestige will provide the disclosures and obtain the authorization required by applicable law before commencing the tow.
Those disclosures may include Prestige's business information, the destination of the vehicle, towing charges, storage charges, additional fees, and applicable customer rights.
A statutory or regulatory disclosure provided for a specific tow forms part of the transaction.
If these general Terms conflict with a mandatory disclosure or requirement imposed by law, the mandatory requirement controls.
08 · Dispatch
A truck or operator is considered dispatched when Prestige assigns or commits a truck/operator to the service request and the operator begins responding to the call or when Prestige otherwise informs the customer that the request has been dispatched.
Once dispatch occurs, the cancellation provisions contained in the Prestige C.K. Towing Inc. Dispatch & Cancellation Policy apply.
09 · Standard Cancellation Fee
The standard cancellation fee after dispatch is $75.
For an unusually long dispatch distance or other distance-related circumstance, Prestige may quote a different cancellation/dispatch fee. Any adjusted amount must be disclosed to and accepted by the customer before the truck is dispatched.
If no different cancellation amount is expressly disclosed and accepted before dispatch, the standard $75 cancellation fee applies.
Cancellation before dispatch ordinarily carries no cancellation fee.
Additional rules appear in the Dispatch & Cancellation Policy, which forms part of these Terms.
10 · Estimated Arrival Times
Any estimated arrival time or ETA provided by Prestige is an estimate only and is not a guaranteed arrival time.
Arrival times may change because of traffic, weather, road closures, construction, accident scenes, police activity, emergency conditions, prior service calls, operator availability, distance, incorrect customer information, equipment requirements, or circumstances outside Prestige's reasonable control.
A delay in an estimated arrival time does not automatically cancel a service request.
If you no longer require service, you must contact Prestige to cancel the request.
11 · Customer Availability
Unless Prestige expressly agrees to unattended service, you or an authorized representative must remain reasonably available at the service location and reachable using the contact information supplied.
You are responsible for providing access to the vehicle and any keys or information reasonably necessary to perform the service.
If an operator arrives but cannot locate the customer or vehicle, cannot access the vehicle, or cannot reach the customer after reasonable attempts, the request may be treated as a no-show or Gone on Arrival (“GOA”), and the applicable cancellation fee may apply.
12 · Unattended Vehicles
Prestige may agree to service an unattended vehicle.
By requesting unattended service, you confirm that Prestige has lawful permission to enter the location and access and transport the vehicle.
You are responsible for accurately identifying the vehicle and providing lawful access instructions.
Prestige may decline unattended service where ownership, authority, vehicle identity, access, destination, or safety cannot reasonably be verified.
13 · Vehicle Condition and Pre-Existing Damage
Many vehicles requiring towing or roadside assistance are already disabled, mechanically compromised, collision-damaged, modified, deteriorated, or otherwise in abnormal condition.
Prestige may photograph or document the vehicle, vehicle location, surrounding area, and visible vehicle condition before, during, or after service.
Pre-existing conditions may include collision damage, mechanical defects, suspension damage, wheel or tire damage, rust, corrosion, loose bodywork, broken glass, fluid leaks, damaged tow points, aftermarket components, low ground clearance, drivetrain problems, electrical problems, or other existing defects.
Prestige is not responsible for damage or failure caused solely by a pre-existing condition, inherent defect, undisclosed mechanical problem, ordinary deterioration, or condition unrelated to Prestige's handling of the vehicle.
Nothing in this section releases Prestige from liability that applicable law does not permit it to disclaim.
14 · Modified, Lowered, Exotic, Electric, and Specialty Vehicles
Customers must disclose unusual or modified vehicle characteristics before dispatch whenever known.
Special procedures may be necessary for electric vehicles, AWD or 4WD vehicles, lowered vehicles, lifted vehicles, vehicles with air suspension, exotic vehicles, vehicles with aftermarket bodywork, oversized vehicles, and heavily collision-damaged vehicles.
Additional equipment or labor may result in additional charges when disclosed and authorized as required.
15 · Winching and Recovery
Recovery operations may involve substantially greater risk, labor, equipment, and time than ordinary towing.
Vehicles located in ditches, snow, ice, mud, water, embankments, restricted-access areas, unstable locations, accident scenes, or other difficult positions may require winching, rigging, additional trucks, additional operators, traffic control, specialty equipment, or other services.
Prestige may stop or decline a recovery where continuing would create an unreasonable safety risk or require equipment or authority not available to Prestige.
Any additional charge will be disclosed as required by applicable law.
16 · Roadside Assistance
Roadside assistance is a limited service and is not a mechanical inspection or warranty.
A successful jump start does not represent that the battery, alternator, starter, charging system, wiring, or electrical system is mechanically sound.
A tire change does not represent that the spare tire, replacement tire, wheel, suspension, lug hardware, or vehicle is suitable for continued operation.
Fuel delivery does not diagnose why a vehicle stopped operating.
Lockout service does not constitute a warranty against pre-existing lock, key, electrical, window, door, or security-system problems.
After roadside assistance, the owner or operator remains responsible for determining whether the vehicle is safe to operate.
17 · Safe Performance of Services
The tow-truck operator retains the right to determine whether a requested operation can be safely and lawfully performed with the equipment and conditions present.
Prestige may refuse, suspend, modify, or discontinue service due to unsafe traffic, severe weather, flooding, fire, hazardous materials, unstable terrain, violence, threats, illegal activity, inadequate access, insufficient equipment, excessive vehicle weight, insufficient clearance, law-enforcement direction, disputed vehicle ownership, suspected fraud, or another substantial safety or legal concern.
18 · Destination
The customer is responsible for providing the correct destination unless the destination is determined by law enforcement, applicable law, an insurer, or another legally authorized party.
The customer should verify that the destination can receive the vehicle.
Prestige is not responsible for the independent conduct, pricing, workmanship, availability, storage practices, or policies of a repair facility, dealership, body shop, parking facility, property owner, or other independent destination merely because Prestige transports a vehicle there.
19 · Destination Changes
A request to change the destination after dispatch or after the vehicle has been loaded may affect the service price.
Prestige will disclose material additional charges before proceeding where required.
Prestige will not unload a vehicle at a location the operator reasonably believes would be illegal or unsafe.
20 · Personal Property
Customers should remove cash, valuables, medication, electronics, important documents, firearms, and other valuable or sensitive personal items from the vehicle whenever reasonably possible before transportation.
Prestige does not undertake to inventory the contents of customer-requested vehicles unless required by law or expressly agreed.
Nothing in this section eliminates a responsibility imposed upon Prestige by applicable law.
21 · Hazardous Materials
Customers must disclose known fuel leaks, chemical hazards, hazardous materials, biohazards, explosives, dangerous cargo, or other unusual hazards associated with a vehicle.
Prestige may refuse a service that creates an unreasonable health, safety, environmental, or legal risk.
22 · Payment
Payment is due according to the price and payment terms disclosed for the particular service.
Prestige may require payment or authorization before dispatch, upon arrival, before release of the vehicle, or immediately following completion, subject to applicable law.
Prestige will provide receipts, invoices, and payment methods required by applicable law.
Nothing in these Terms limits a method of payment that Prestige is legally required to accept.
23 · Storage
If Prestige accepts a vehicle for storage, applicable storage charges and vehicle-release procedures will be disclosed and administered according to applicable law.
Statutory lien rights, release procedures, notices, redemption rights, abandoned-vehicle procedures, or governmental requirements are not modified by these Terms.
24 · Photographs and Service Documentation
Prestige may create and retain photographs, video, dispatch timestamps, GPS information, operator notes, customer communications, electronic approvals, invoices, payment records, and other service documentation for legitimate purposes including safety, service performance, regulatory compliance, insurance, fraud prevention, billing, dispute investigation, and defense of legal claims.
Such information is handled according to the Prestige C.K. Towing Inc. Privacy Policy and applicable law.
25 · Damage Claims
If you believe Prestige caused new damage to your vehicle, contact Prestige as soon as reasonably practicable after discovering the alleged damage.
Provide the service date, customer name, vehicle information, service or invoice information, a description of the alleged damage, and available photographs or documentation.
Prompt notification allows Prestige to preserve photographs, GPS records, operator records, dispatch information, communications, and other relevant evidence.
A delay in reporting does not eliminate a right that applicable law does not permit Prestige to waive.
26 · Allocation of Responsibility
Prestige remains responsible for conduct for which it is legally responsible.
To the maximum extent permitted by law, Prestige is not responsible for loss caused solely by pre-existing damage, undisclosed defects, mechanical failure unrelated to Prestige's handling, inaccurate information provided by the customer, conduct of unrelated third parties, governmental action, severe weather, roadway conditions, natural disasters, or circumstances reasonably outside Prestige's control.
27 · Indirect and Consequential Loss
To the maximum extent permitted by applicable law, Prestige is not responsible for remote or consequential economic losses that do not directly result from legally actionable physical damage caused by Prestige, including lost profits, lost business, missed appointments, travel expenses, hotel costs, or similar consequential losses.
This provision does not restrict a remedy that applicable law does not permit the parties to limit.
29 · Text Messages and Calls
By providing a telephone number in connection with a service request, you authorize Prestige to use that number for reasonable communications concerning that request, including dispatch confirmation, driver contact, ETA information, location clarification, service updates, payment information, receipts, and callbacks.
Service-related consent is separate from consent to receive marketing communications.
Prestige will not require consent to marketing text messages as a condition of purchasing towing or roadside services.
31 · Non-Consensual and Private-Property Towing
These Terms are primarily intended for customer-requested services.
Non-consensual private-property relocation towing is subject to separate statutory, regulatory, signage, notice, rate, and vehicle-release requirements.
Nothing in these Terms replaces those requirements.
32 · Force Majeure and Events Beyond Reasonable Control
Prestige is not responsible for delays or inability to perform caused by circumstances reasonably beyond its control, including severe weather, flooding, major accidents, road closures, emergency activity, civil emergencies, governmental orders, mechanical breakdown of service equipment despite reasonable maintenance, communications outages, or similar events.
This section does not eliminate obligations that applicable law imposes notwithstanding such events.
33 · Complaints and Billing Disputes

Prestige may review dispatch records, GPS information, photographs, operator notes, invoices, payment records, telephone or text communications, and related documentation when investigating a dispute.
Nothing in these Terms prevents a customer from exercising lawful rights with an insurer, payment provider, court, regulator, law-enforcement agency, or governmental authority.
34 · Governing Law and Venue
These Terms are governed by the laws of the State of Illinois and applicable federal law.
To the extent the parties may lawfully agree to venue, any judicial proceeding relating to these Terms or a customer-requested service shall be brought in a court of competent jurisdiction located in Cook County, Illinois.
35 · Severability
If a court or other authority determines that a provision of these Terms is invalid or unenforceable, that provision shall be interpreted or limited to the minimum extent necessary, and the remaining provisions shall continue in effect to the fullest extent permitted by law.
36 · No Waiver
Failure by Prestige to enforce a provision on one occasion does not constitute a permanent waiver of that provision or any other right.
37 · Entire Service Agreement
These Terms, the Dispatch & Cancellation Policy, the Privacy Policy where applicable, the customer's particular quote or authorization, and any disclosure required by law collectively govern the applicable service.
A specific legally required disclosure or specifically agreed service term controls over inconsistent general website language.
38 · Changes
Prestige may update these Terms periodically.
The Terms in effect when a service is requested generally govern that service unless a different rule is required by applicable law.
